Every CMV must pass a periodic (annual) inspection meeting the §396.17 standards, performed by a qualified inspector. A missing or expired annual inspection is a frequent roadside and audit finding.

Section 396.17 requires every CMV to pass a periodic (annual) inspection that meets the standards in 49 CFR Part 396, Appendix A. The inspection must be performed by a qualified inspector under §396.19, and the report must be retained by the motor carrier for at least 14 months.

What's inspected

The §396.17 inspection covers the items in Appendix A — including brake systems, steering, suspension, tires, wheels, frame, and lighting. State inspections that meet or exceed the federal standard satisfy §396.17 in most cases (subject to FMCSA recognition of the state program).

Inspector qualifications

Inspectors must meet §396.19 — generally meaning training and experience in CMV inspection. The inspector's qualifications must be documented and retained.

Common findings

  • No annual inspection on file.
  • Inspection performed by an unqualified inspector (e.g., a driver who has not met §396.19).
  • Inspection report missing required items.
  • Sticker on the vehicle but no underlying report retained.

  • Schedule the inspection before the prior one expires, with 30 days of buffer.
  • Use a shop that issues a complete §396.17-compliant report — not just a sticker.
  • Retain the inspector's qualification documentation alongside the report.
  • Track expiration centrally; this is a §396.17 violation with bite.
